The Office is an exempt agency under the Freedom of Information Act 1992.
The Office can only release documents where the release of the documents would not contravene the confidentiality provisions of the Parliamentary Commissioner Act 1971. Where we receive an application by a complainant for access to documents held by our Office, our general policy is that we will only provide copies of those documents that the complainant has sent to us or that we have previously sent to the complainant.
Other agencies that receive applications for access to documents that have originated from this Office or have been specifically prepared for the Ombudsman are required to notify us of such applications so that we have the opportunity to identify any sensitivities in the documents.
